As enforcement actions against deceptive user interface design ramp up, in-house legal teams are under increased pressure to ensure that UX decisions don't unintentionally cross regulatory lines. From the FTC to state attorneys general and international regulators, legal scrutiny around so-called "dark patterns" is intensifying—particularly in areas like subscription flows, consent collection, and cancellation processes.
In this session, we’ll explore how legal teams can proactively address UX compliance and reduce exposure by embedding legal review into product and marketing workflows. Panelists will share firsthand insights and practical guidance on how to identify and mitigate risk, conduct internal audits, and align with evolving global standards.
Through interactive discussion, we will:
- Define what qualifies as a “dark pattern” under FTC and state AG standards
- Examine common UX pitfalls in subscription flows, consent banners, and cancellation designs
- Discuss legal’s role in cross-functional alignment with product and marketing teams
- Share strategies for internal audits, documentation, and policy development to prepare for enforcement
This program is eligible for up to 1 hour of CLE credit in 50-minute states and 1 hour of CLE credit in 60-minute states.
Credit hours are estimated and are subject to each state’s approval and credit rounding rules. This course is appropriate for experienced attorneys only.
