Rethinking Employment Law Risk: Federal Non-Discrimination Law Under the Trump Administration
Over the last several years, the technology industry has faced pressure to diversify its workforce and leadership teams - enter DEI programming, expanded recruitment efforts, and measured accountability. However, starting on day one of the Trump Administration, the President and the rest of the executive branch have taken steps to eliminate “Illegal DEI.” Remake non-discrimination law in the U.S.
These efforts resulted in scrutiny of DEI and related programs in the tech space and beyond, calling into question their continued viability. Following the issuance of several executive orders, federal non-discrimination agencies revised important regulations, rescinded or issued critical guidance, and shifted their enforcement priorities. Some examples include launching investigations into the DEI practices of large employers, rescinding long- standing guidance on disparate impact, refocusing EEOC’s resources on “reverse” discrimination, proposing to eliminate the EEO-1 Report, and suspending all enforcement of federal laws prohibiting discrimination against disabled individuals and veterans applicable to federal contractors.
These efforts have fundamentally altered the legal landscape and reshaped how employers evaluate risk. This presentation will cover what has changed in the 2 years since the re-election of President Trump and offer practical strategies for technology employers seeking to attract and retain talent while maintaining legally compliant employment practices.
Topics covered during this presentation will include:
- EO 14173
- EO 14398
- Elimination of EO 11246
- DOJ Civil Investigative Demands
- Potential elimination of EEO-1 Report
- Realignment of EEOC enforcement priorities
- Scaled back government contractor compliance efforts
- Practical compliance strategies
